中级人民法院在司法改革试点中的地位与作用 ———基于司法改革典型案例的分析

The Status and Role of Intermediate People's Courts in the Pilot Judicial Reform—Analysis Based on Typical Cases of Judicial Reform

摘要:

在 “顶层设计” 的同时, 通过局部性 “试点” 尝试效果, 积累经验, 探索改革方案, 已成为 我国司法改革的重要策略和进路。 通过对最高人民法院发布的 187 个司法改革典型案例的分析可以看出, 我 国不同层级法院在试点改革中的地位与作用并不相同。 相较于其他层级的法院, 中级人民法院在试点改革中 具有更为突出的地位。 司法改革的试点可分为自发性改革试点、 引导性改革试点、 参与性改革试点三种类 型, 在这三种类型中, 中级人民法院各有其特定的作用形态与方式。 为更好发挥司法改革试点的作用, 有必 要进一步明确中级人民法院作为试点改革枢纽的突出地位, 将试点基本单元主要设定于中级人民法院层级, 以中级人民法院为基础选择试点法院, 尤其是突出省会城市中级人民法院在试点中的引领作用。

Abstract:

In addition to the _"top-level design_" trying out the effects through local _" pilots accumulating experience and exploring reform solutions have become vital strategies and approaches for China?s judicial reform. An analysis of 187 typical cases of judicial reform issued by the Supreme People?s Court shows that the status and role of courts at different levels in China?s pilot reform are different. Compared with other levels of courts the position of intermediate courts is more prominent in the pilot reform. There are three types of pilot judicial reform spontaneous guided and participatory each of which has its specific role and approach. To underline the role of pilot judicial reform it is necessary to stress the prominent position of intermediate courts which is a hub of pilot reform set the basic unit of pilot mainly at the intermediate court level and select pilot courts based on intermediate courts especially highlighting the leading role of intermediate courts in provincial capitals.
